Outdoor Burning Regulations & Burning Ordinance of Bushkill Township
While outdoor burning is permitted, all residents of Bushkill Township are encouraged to take their brush and grass clippings to the Bushkill Township Highway Garage at 897 Clearfield Road. Accepted items at the garage include leaves, small brush, trimmings, plantings, branches up to 6 inches in diameter and Christmas trees. There is also FREE mulch available to all Bushkill Township residents. This is part of the First Regional Compost Authority. You can also drop off at the Central Processing Center, 6701 Weaversville Road, Northampton. Proof of residency required. For more information visit http://www.frcaweb.org/ .
Permission from the fire chief of the Bushkill Township Volunteer Fire Company is REQUIRED for the following burns.
The best time to contact a fire chief is Monday night between 7:00pm - 9:00pm. Call the firehouse 610-759-2274

* Leaf Burning
* Any Open Burn
IMPORTANT REQUIREMENTS MUST be met for burning:
* NO pile shall be larger than 4 feet wide by 4 feet long
* NO pile shall be taller than 4 feet high
* NO burning during a Township or County wide burn ban
* NO burning on days where winds are over 10 miles per hour
* NO burning during Fire Weather Watch days
* NO burning during RED FLAG WARNING days
* NO burning within 50 feet of any building or property line unless permitted by the fire chief.
* NO burning between dusk and dawn unless permitted by the fire chief.
* NO burning in streets, sidewalks, alleys, or public grounds of the Township.
* NO burning of plastics, tires, or synthetic fabrics.
* NO industrial or commercial burning at ANY time.
* NO burning within 50 feet of Jacobsburg State Park or State Game Land.
* NO burning North of Mountain Road or Old Allentown Road unless permitted by the fire chief.
* Have a garden hose, shovel, or heavy equipment nearby to extinguish any spot fires or quickly contain a fire out of control.

* All barrels MUST have a mesh screen no larger than 1/2 inch over top at all times of burning.

AN ORDINANCE
REGULATING AND RESTRICTING OUTDOOR FIRES WITHIN THE TOWNSHIP
OF BUSHKILL AND PROVIDING PENALTIES FOR VIOLATION THEREOF.

ORDINANCE NO. 2005-08
AN ORDINANCE
REGULATING AND RESTRICTING OUTDOOR FIRES WITHIN THE TOWNSHIP
OF BUSHKILL AND PROVIDING PENALTIES FOR VIOLATION THEREOF.
BE IT ENACTED AND ORDAINED by the Board of Supervisors of the Township of Bushkill, Northampton County, Pennsylvania (the "Township") and it is enacted and ordained, as follows:
SECTION 1. The purpose of this ordinance is to prevent public and private nuisances caused by outdoor fires deliberately or carelessly set and maintained; and to avoid unnecessary calls and false alarms to the Bushkill Township Volunteer Fire Department.
SECTION 2. No fire shall be set or maintained within fifty (50') feet to any building or property line, unless a prior permit for the same shall have been issued by the Bushkill Township Volunteer Fire Department, which permit shall issue by order of the Fire Chief or other persons authorized by him.
SECTION 3. No fire shall be set or maintained upon any of the streets, sidewalks, alleys or public grounds in the Township, or to burn or cause to be burned thereon any paper, boxes, rubbish, leaves or other materials or substances of any kind.
SECTION 4. No fire shall be set or maintained from dusk to dawn, or windy days.
SECTION 5. No industrial or commercial burning of any kind shall be permitted in the Township at any time.
SECTION 6. No plastics, synthetic fabrics, or tires shall be burned in the Township at any time.
SECTION 7. No outdoor burning shall be permitted North of Mountain Road and Old Allentown Road, unless a prior permit for the same shall have been issued by the Bushkill Township Volunteer Fire Department, which permit shall issue by order of the Fire Chief or other persons authorized by him.
SECTION 8. No fire shall be set or maintained within fifty (50') feet to Jacobsburg State Park land or within fifty (50') feet of State Game Land.
SECTION 9. All open fires, except field fires, shall be built-in and confined to a non-combustible container covered with a screen of one-half inch or smaller mesh
SECTION 10. The burning of recyclables is prohibited.
SECTION 11. The Supervisors by Resolution or the Fire Chief of the Bushkill Township Volunteer Fire Company may from time to time declare a moratorium on all open burning with the Township; such prohibition shall be necessary for the elimination of fire hazards, explosive conditions or excessive air pollution which would result from air inversion condition.
SECTION 12. If any clause, section or part of this Ordinance is, for any reason, found to be unconstitutional, illegal or invalid, such unconstitutionality, illegality or invalidity shall not affect or impair any of the remaining provisions, sentences, clauses, sections or parts of this Ordinance. It is hereby declared to be the intent of the Board of Supervisors that this Ordinance would have been adopted had such unconstitutionality, or invalidity not been included here in.
SECTION 13. Any person, firm or corporation violating the provisions of this Ordinance, upon conviction before a District Magistrate or Court of Common Pleas of Northampton County, shall be subject to pay a fine of not more than Three Hundred ($300.00) Dollars and costs of prosecution, and, in default thereof, imprisonment in the Northampton County Prison for a period not to exceed ninety (90) days.
SECTION 14. All Ordinances or parts thereof inconsistent herewith are hereby repealed.
